And that would be 5 to 15 more floors they would have to pay for with high interest rates with bleak prospects of obtaining tenants. This isn't monopoly money these development firms are borrowing.

The effort has stalled due to what court documents describe as financial concerns from the would-be tenant, with ONE22ONE owner GBT Realty having sued Chotto Matte and owner Kurt Zdesar for $453,445.27 in back rent.

According to filing in Davidson County Chancery Court, Zdesar and GBT could not agree upon a plan that would allow the former sufficient time to secure capital to pay for the build-out of the space.

According to a court filing by Zdesar, the Chotto Motte team explained "the then-current shortfall in funding and excessive construction budget" to GBT officials at an April on-site meeting. At a June meeting, according to the filing, the parties discussed options for ONE22ONE to help fund the buildout of the space. Shortly after that meeting, according to the filing, a GBT representative told the Chotto Motte team that they would not be able to fund the project.

Then in July, according to the filing, the Chotto Motte team secured a $5 million personal loan to help fund the project but it was too late, as a GBT representative on Aug. 9 informed the restaurateurs that "ONE22ONE had lost faith in us and did not want us to participate in the project."

On Tuesday, GBT moved to voluntarily dismiss the case, shortly after it was transferred to federal court, and it is unclear if a settlement between the two parties has been reached.
