I disagree with your first point, but I guess there's no getting past that. Not a legal expert so can't comment there. I think drivers should, but that's a non sequitur......

Ah but do we know how fast the driver was going? I think the second point you are making is assuming what you have to demonstrate. By your standard, in every case of a pedestrian being hit, the driver is driving too fast. Pedestrians should take extra precautions if it's dark and/or raining. Crossing Sharon Rd while not in a crosswalk and nowhere near a signalized intersection / stop sign in the dark, in rainy conditions is just plain not smart.

To me it's not blaming the victim to point out that the person was trying to cross in the dark, in the rain, nowhere near a traffic light, and not in a crosswalk.

Originally, I had it in my head that KK had like a 300K sf HQ in Winston and a 40K sf office in Charlotte, but it looks like the split is only 90K / 40K, so your point is taken.

The sad part is that this is not too far off from what the old econ development folks (3 months ago) used to do. They have 3 of the top 5 worst pitches I've ever seen.

My understanding is that the HQ is still in Winston, it's just that the executives are now in Charlotte.

This x 1,000,000. It's definitely post-hoc rationalization. Don't kid yourself, if you had HQ2 coming, you would have taken it 100 / 100 times. Crystal City might suck today, but JBG bought it to transform it. Given all that's going on in Arlington and continued progress in Pentagon City, it's very conceivable that this will be cool in a decade or so once HQ2 is built out.
