Our lawsuit against the city of Greenville is finally coming up on the docket.We will be arguing that RDV is an illegal zoning ordinance.At this time my brother and I are interested in hearing from other parties that are of the same opinion.I can be contacted through this forum, we are looking for some support.Fighting the city will not be easy for us,and any help would be greatly appreciated !

I'm not interested in tower cranes.All I want is a zoning classification that has my rights and restrictions defined.The ability to convey these rights and restrictions to any potential future investor makes a significant impact on the value of the property.Investors are less likely to be interested in a property if zoning regulations are not clearly defined and applied.
  3. The owner decided to build on his property and should have the right to decide who his tenant is now and in the future.Not the city nor WENA.

How can you differentiate between a locally based business and a local franchisee of a corporate business?They would both be locally owned.Denying a use based on potential traffic is illogical,who's to say that a local business would cause less congestion?Does the city and West End home owners association have the right to decide the highest and best use of privately owned properties?RDV has the potential for terrible abuse of power and authority
  5. It appears that nobody wants to comment on arbitrary and capricious,let me put it another way.Cherry picking is illegal.The fact that RDV has been used as a basis for who can and who cannot do business on Pendleton St is cherry picking.Therefore RDV is an illegal zoning ordinance.
  6. A zoning ordinance should have a firm set of rights and restrictions,it should not be arbitrary or capricious
  7. I can't understand how a zoning ordinance can allow a local business to have the right to operate yet deny that to a corporate owned business.
  8. Does this set a precedent that locally owned businesses will all be granted a special exemption to (build,own,operate) a drive thru in the Pendleton St RDV zoning district?

  12. Looks like the West End home owners association is opposed to this development. Surprise,surprise.
  13. We can not expand our footprint,or make a capital investment of more than 25% of the property value.Our current tenant has expressed an interest in expanding the dining area and other changes to the structure.
  14. At this point, We'll take our chances in court.If we win the whole RDV concept may collapse and everyones zoning will revert to their prior classification

  16. Pendleton St.should be the main route into downtown Greenville and a C3 rating is appropriate regardless of the name.
  17. Christos Hassiotis was my father.He was forced out of his prior property by the city.He would never had sold it without an extended period of pressure and threats by the City of Greenville.
  18. We built a drive through nearly thirty years ago in a run down depressed area of Greenville that had no value after running us out of our prior property. Now that it does,the city neferiously has proceeded to cause us financial difficulties again.The city will never apologize for what they did to our parents.Our only recourse is to fight for our constitutional rights in defense of our prior property and our current.
  19. When we built the new Boston Lunch in 1992 we hoped to be the one of the linchpins to the revitalization of Pendleton St.Now that revitalization is coming we are disposable,just like we were in the Piazza Bergamo.
  20. I was there and so was my attorney.This is not done by a longshot.The city will be answering in court.Depositions starting.
  21. So you're in favor of the city taking property rights from their owners on a generational basis.

The city first threatened to condemn our prior building then used eminent domain to steal it from my father.After we broke ground due to property gain tax situation the city put our prior property up for sale.They gave us $190,000 sold it to Sassafras for $1.1 million.The documentation is in public records, if you would take some time to do some research.RDV devalues our property again because it limits our potential to develop or expand without getting the city of Greenville to approve.
