  1. I see that Perry Avenue is being repaved.It seems to me that painting a couple of bike lanes on either side would be safer than going down Pendleton St for bicyclists myself included.
  2. I was attacked on this forum before I ever posted a word.I will continue to post as long as I am allowed to.I have that right and the right to defend myself in court.Does that satisfy your curiosity?
  3. This is a public forum and I have the right to express myself,If we lose we will at least have defended ourselves.The consequences for the City will be much worse if they lose.

My brother and I are defending ourselves and the interests of future commercial property owners.The city has not in any way try to placate or allay our fear and discomfort.It does not help when the WE neighborhood association gangs up against us as well.Our only option is a Judicial review with a jury trial.We will pursue a just and reasonable outcome at our expense.If it comes out that RDV is an illegal zoning ordinance and that we were treated differently than our neighbors then the city will have to answer for itself.   5. If the city decided to build a hard or elevated median it would restrict the direction which you could either enter or exit a structure.That would cause access issues and dissuade certain uses.
  6. Restricting access would have the same effect as any ordinance.

I do not mind Pendleton St changing to two lanes with a central turn median and two bike lanes on either side.Nice sidewalks for pedestrians would also be great.Both would not be an impediment to retail businesses, drive throughs included.I would vehemently oppose any elevated/impassable median that restricted access or departure.

Pendleton St is different than Main St.Any attempt to bridge the gap between Main St and the Village at West end is going to have to have a wide and diverse mix of retail and commercial use.Drive through restaurants offer another option to the growth of that corridor.RDV is the wrong zoning if you want to encourage growth.

  13. I know that this property is zoned differently than the adjacent property (the car wash),what would be the position of WE neighborhood and the city if it were to be redeveloped into another establishment that also served alcohol?
  14. What is the position of the WE neighborhood and the city on the possibility of alcohol consumption on this properly? In favor or not?

  16. Socrates and French Enlightenment aside,growth was coming to this part of town.I concur a zoning ordinance should govern what types of business are allowed. It should not allow special interests,the rich,or the powerful to have an advantage that those less fortunate do not enjoy.RDV allows for an uneven playing field.A clearly worded well thought C3 could and would bring more growth to Pendleton St.

It is illegal for a zoning ordinance to discriminate between functionally equivalent businesses.It is illegal for a zoning ordinance to discriminate between locally owned businesses and national chains.It is illegal for a zoning ordinance to be arbitrary and capricious.RDV has already been shown to have all of these characteristics
  20. How does a minority owned business operating a drive through cater to vice and extort the poor?
  21. Laws should have clear and defined rights and restrictions.RDV allows for special exemptions and a Mob rules mentality where the city and local homeowners decide which business/tenant is acceptable and which isn't.

My grandfather is only good for a period of six month vacancy.If the building remains unoccupied for longer than that, any new tenant would have to apply for a special exemption to use the drive through window.The building was designed to generate 1/3 of it's revenue and traffic by it's use.During this period of Covid it's been shown to be an essential part of doing business.This RDV zoning was aimed at us,we were the only drive through on Pendleton St when this ordinance was conceived. We do not trust the city,they have done nothing but harm to our family.

  25. How is RDV raising the bar? Special exemptions for the rich and powerful,nada for the rest of us
